Terms of Service

Draft. These terms describe how we expect the service to work, in plain language. They are pending review by qualified counsel before public launch. Material changes will be announced via email and posted here with a revised date.
Who these terms are between
These terms are an agreement between you and Color Me Stylist (“CMS”, “we”, “us”). By creating an account or using the service, you agree to them. If you do not agree, do not use the service.
What the service is
CMS is a two-sided platform. Clients hire personal stylists for image work. Stylists subscribe to CMS as their CRM, workflow, and delivery system. We provide the software; the styling relationship is between you and your stylist.
Account eligibility
- You must be at least 18 years old.
- You must provide accurate information when you sign up.
- You are responsible for keeping your password secure and for activity that happens under your account.
- You can have only one personal account. Stylist and client accounts must use different email addresses.
Roles
Clients
Clients pay their stylist for styling services. The stylist sets their fees. We do not charge clients a separate platform fee.
Stylists
Stylists pay a subscription to CMS to use the platform. The subscription tier (Solo, Boutique, Studio, Agency, Specialist) determines the features and client capacity available to the account.
Agency leads
On the Agency tier, an account holder can build a team and manage other stylists. The agency lead is responsible for the stylists on the team and for the data they handle.
Subscriptions and billing (stylists)
- Subscriptions are billed monthly or annually depending on the plan you choose.
- Payment is processed by Stripe. By subscribing, you agree to Stripe’s terms.
- Subscriptions auto-renew unless you cancel before the renewal date. You can cancel any time from your account.
- We do not pro-rate refunds for partial months. Cancellation takes effect at the end of the current billing period.
- If a payment fails, we will retry and may suspend your account if payment is not received.
Client styling fees (clients)
Fees for styling work are set by your stylist and paid to your stylist. CMS is not a party to that transaction. If you have a dispute with your stylist about fees or service quality, raise it with your stylist first. If you cannot resolve it, contact support@colormestylist.com and we will help where we can.
What you can do with the service
- Use it for its intended purpose: receiving or providing personal-styling services.
- Upload your own content (photos of your closet, your own notes) and content you have a right to use.
- Communicate with your stylist or your clients through the in-app tools.
What you cannot do
- Use the service for anything illegal.
- Upload content that infringes someone else’s copyright, trademark, or other rights.
- Harass, threaten, or harm anyone using the platform.
- Attempt to reverse engineer, scrape, or otherwise access the platform outside its normal use.
- Resell, sublicense, or pass off the service as your own.
- Use the service to send marketing email or other unsolicited communication.
- Bypass authentication, rate limits, or other security measures.
- Train external AI models on data you accessed through the service.
Your content
You own the content you put into CMS — your photos, intake answers, notes. You grant us a limited license to host, display, and process that content as needed to provide the service to you. We do not claim any other rights to your content. We do not sell it, license it to advertisers, or train external AI models on it.
Stylists own the working notes and diagnoses they produce. They grant us the same limited license for the same purpose. When a client account is deleted, the notes attached to that client are deleted with it.
Sensitivity commitments
CMS is built on body-neutral principles. We commit to:
- Never display body-shape categorization that you did not opt into.
- Never auto-recommend culturally significant items unprompted.
- Never use industry vocabulary that frames thinness as the goal, names parts of the body as defects, or implies age dictates what someone should wear.
- Never show streak counters, leaderboards, or comparative gamification.
- Keep stylist-only fields (pattern tags, clinical referral flags) out of the client-facing UI.

Service availability
We aim for high availability but do not guarantee uninterrupted service. We may need to take the platform down for maintenance, security updates, or to fix bugs. We will give notice for planned downtime where possible.
Account suspension and termination
We may suspend or terminate an account that violates these terms, infringes someone else’s rights, or is used in a way that endangers other users or the platform. We will give notice and a reasonable chance to fix the issue except in cases of severe abuse, fraud, or legal requirement.
You can close your own account at any time. Clients can self-serve at /account. Stylists email support to coordinate roster handoff first.
Disclaimers
CMS provides software for styling work. We are not personal stylists, fashion advisors, mental-health professionals, or medical providers. Information shared by stylists through the platform is their professional opinion, not ours.
The clinical referral resources that appear in some parts of the app (national crisis lines, community resources) are third-party services we do not operate. We provide them as convenient pointers. We are not responsible for their availability or quality.
The service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these terms, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limit of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data.
Indemnification
You agree to indemnify and hold harmless CMS, its officers, and its employees from claims, damages, and costs arising out of your misuse of the service, your violation of these terms, or your violation of someone else’s rights.
Governing law and disputes
These terms are governed by the laws of the state in which CMS is incorporated, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that state, or through binding arbitration if both parties agree.

Changes to these terms
We may update these terms. Material changes will be announced via email and posted here with a revised date. Continued use of the service after a change means you accept the updated terms. If you do not agree, close your account.
